1) General information
1.1) These General Terms and Conditions of Sale are for the purchase of products carried out remotely via computer on the website www.business.lafocacceria.com, belonging to SANMICHELE srl, with registered office in Milan (MI), in Via Fatebenefratelli n.20 (hereinafter referred to as Business.lafocacceria.com).
1.2) The purchase order can be completed after the user registers on the website by entering the personal data necessary for processing the order and for shipping: company name, VAT number, personal data of the legal representative, address of the registered office, telephone number, email address, any shipping address other than the billing address.
1.3) Every purchase transaction will be governed by the provisions of Legislative Decrees 185/99 and 206/05; the information concerning the validity of the contract will be governed by art. 12 of Legislative Decree 70/03 and, with regard to the protection of confidentiality, will be subject to regulation under Legislative Decree 196/03.
2) Processing of personal data
2.1) Business.lafocacceria.com hereby states that, pursuant to art. 13 of Legislative Decree 196/2003, the personal and fiscal data acquired in reference to the commercial relationships established, including verbally, provided directly by the interested parties, or otherwise acquired within the company's activity, will be treated in compliance with the aforementioned legislation, including confidentiality obligations set forth thereby. In relation to the above, the rights under art. 7 of Legislative Decree 196/2003 may be exercised.
2.2) Without prejudice to the specific mandatory legal provisions, for the purposes of this contract the Customer agrees to receive communications from business.lafocacceria.com in electronic form and acknowledges that all contracts, notifications and information received in electronic form meet the requirement of the written form, when required by law.
3) Terms and conditions of sale
3.1) The contracts for the sale of products on business.lafocacceria.com are considered concluded when the purchase order placed by the customer is sent to Business.lafocacceria.com and the latter accepts it. Business.lafocacceria.com will send the customer a receipt for the purchase order they have made promptly.
3.2) By sending their purchase order electronically, the Customer declares that they have read and accepted these general contractual conditions and undertakes to observe and respect them in their relations with Business.lafocacceria.com. The Customer is therefore required to read these contractual conditions before submitting their purchase order, and once the online purchase procedure has been completed they are also required to print out and keep them.
4) Product characteristics and prices
4.1) It is possible to place an order through the Business.lafocacceria.com website for the products available at the prices and conditions indicated therein. The Customer purchases the product, the characteristics of which are illustrated online in the relative descriptive sheets, at the price indicated therein, to which the shipping costs indicated on the website are added.
4.2) The visual representation of the products on the website corresponds to the photographic image accompanying the descriptive sheet: this image has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and qualities but may differ in terms of color and size. The images are provided for illustrative purposes only and do not constitute a contractual element, the description on the product sheet shall always prevail.
4.3) The sales prices indicated on the website Business.lafocacceria.com are expressed in Euros and are inclusive of standard packaging costs, however they do not include VAT (if applicable), any indirect taxes (if applicable) or shipping costs, which are calculated before the order is confirmed and which may be free for particular temporary promotions communicated on the website.
4.4) The prices, products and/or features thereof are subject to change without prior notice. Therefore, before sending the purchase order, the Customer is invited to check the final sale price, which will be summarized as follows: unit cost of each chosen product, total cost (in case several products are purchased), VAT (if applicable) and related delivery costs.
4.5) The purchased product is perishable and is delivered at the stipulated temperatures in compliance with the cold chain.
4.6) The customer is aware that the product must be stored in a freezer at a temperature of at least -18°C at the time of delivery. Once thawed, the product should not be refrozen.
5) Method of purchase
5.1) In order to view the prices and proceed with the purchase order, the Customer will be asked to provide their data; they can also choose whether to create an account or to log in, if they are already registered. The Customer will also be asked to explicitly accept these contractual conditions through the appropriate check-box on the website.
5.2) After selecting the products, the Customer must access the Shopping Cart where they will view a summary of the order to be carried out, the contents of which may be modified in any case.
5.3) The Customer can only select Bank Transfer as the payment method.
5.4) Once the order has been submitted, the Customer will receive an email from Business.lafocacceria.com with the summary of the purchase order, the order number and a list of the goods purchased and the price including delivery costs. The email will indicate the bank details for paying the balance of the order and it will be necessary for the Customer to send a payment receipt in response to the email received or alternatively by writing an email ex novo to info@lafocacceria.com. The processing of the order will start the day after receipt of the payment receipt.
The email will also contain a reference to the general contractual conditions and information about the existence of the right of withdrawal, the conditions and methods of its exercise specified on the website Business.lafocacceria.com.
5.5) The Customer is aware that modification or cancellation of the order can be made within 48 hours of receipt of the summary email, and a refund can be claimed if the order is cancelled within the aforementioned time periods.
6) Fulfillment of orders
6.1) The order is processed in a timeframe of 10 working days starting from the day following the date on which the Customer sends the payment receipt.
6.2) Order fulfillment is subject to the availability of the Products and to the acceptance by Business.lafocacceria.com, which reserves the right to refuse an order at any time and at its unquestionable discretion, including, for example, cases in which the products ordered are no longer available on the website, in which the order cannot be executed due to the closure of the workshop (holidays/vacations) or in which it cannot be delivered due to the unavailability of the carrier.
6.3) In all cases in which Business.lafocacceria.com is unable to process an order or is only partially able to do so, it will contact the Customer by email or telephone via the addresses provided at the time of registration on the website as soon as possible and in any case within 48 hours of the order being placed on the Website. Any payments already made by the Customer will be promptly reimbursed by Business.lafocacceria.com with the same methods used by the Customer to pay for the products.
7) Product availability and shipping
7.1) The electronic commerce system adopted on the website Business.lafocacceria.com is designed to guarantee the Customer maximum transparency, indicating the availability of products in stock in real time.
7.2) The products purchased are sent by refrigerated courier to the address specified by the Customer at the time of registration. A courtesy copy of the invoice will be sent by email when the delivery is completed. When the goods are entrusted to the carrier, Business.lafocacceria.com will send a notification to the Customer by email, specifying the information necessary for tracking them.
7.3) The website Business.lafocacceria.com can be accessed from all over the world, however the products available in the online shop can only be purchased by users who request delivery in the EU. The time required to ship the order is related to the destination.
8) Delivery
8.1) The carrier responsible for deliveries is SVAT.
8.2) It is not possible to arrange specific delivery times. Deliveries are normally scheduled from 7:00 AM to 6:00 PM.
8.3) In the event of non-delivery due to the absence of the recipient at the address indicated by them in the order, the goods will be stored at the courier's nearest office. It will be the Customer's responsibility to reschedule the delivery. Any costs or penalties applied by the carrier in case of storage will be charged to the Customer with a specific item on the invoice and must also be paid by Bank Transfer.
8.4) Business.lafocacceria.com undertakes to do everything in its power in order to respect the delivery times indicated and cannot be held responsible in any way for any loss or damage suffered by the Customer due to delays in the delivery of the Products, unless this delay is attributable to willful misconduct or the fault of the seller.
8.5) Warning: the product is frozen and must be kept at a temperature of -18°. Business.lafocacceria.com will not be held responsible in the event that the carrier or the Customer fails to respect the cold chain.
9) Payment
The Customer can make the payment by Bank Transfer to the account details that they will receive by email when the order is sent.
10) Complaints and returns
10.1) Upon receipt of the goods, the Customer is required to check their condition and compliance immediately. If the packaging or the wrapping of the products ordered by the Customer should arrive at the destination clearly damaged, the Customer is obliged to accept the delivery "conditionally" noting the "condition" on the delivery note or, alternatively, they may refuse delivery by the carrier/shipper.
10.2) Any complaints relating to the compliance of the products, including in relation to their quantity and/or external appearance, must be made in writing via email to info@lafocacceria.com.
10.3) For obvious reasons of perishability, the products that can be purchased on the website Business.lafocacceria.com fully fall within in the cases of exclusion from the right of withdrawal indicated in the following article.
11) Right of withdrawal
11.1) Pursuant to art. 59 Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014, the right of withdrawal is excluded in the following cases:
- orders of Products that are made to measure or clearly customized;
- orders of Products that are liable to deteriorate or expire rapidly;
- orders of sealed Products that do not lend themselves to being returned for reasons of hygiene or protection of health, or which have been unsealed after delivery.
11.2) With reference to the cases of exclusion of withdrawal listed above, the Customer, in particular, is informed and accepts that the products that "risk deteriorating or expiring quickly" include those products of a food nature whose characteristics and qualities are subject to alteration, also as a result of inappropriate storage by the Consumer.
